The Department of Justice has renewed its efforts to secure the release of federal jury records from the probe into the disgraced financier, which resulted in his criminal charges in 2019.
The recently filed petition, prepared by the government lawyer for the Manhattan district, declares that legislators made it clear when approving the release of case documents that these judicial documents should be unsealed.
"The legislative move superseded current regulations in a manner that enables the disclosure of the federal jury documents," noted the justice department.
The legal document asked the New York federal court to move swiftly in making public the records, citing the 30-day window set after the bill was signed into law last week.
However, this latest attempt comes after a prior motion from the Trump administration was denied by the presiding judge, who pointed to a "substantial and convincing justification" for maintaining the documents sealed.
In his summer decision, the judge observed that the seventy pages of grand jury transcripts and evidence, including a digital presentation, call logs, and letters from survivors and their lawyers, are minimal compared to the federal vast accumulation of case-related materials.
"The government's 100,000 pages of case documents dwarf the limited grand jury materials," noted the magistrate in his ruling, observing that the request appeared to be a "detour" from making public documents already in the government's possession.
The confidential documents mainly include the statement of an government agent, who served as the lone witness in the sealed sessions and reportedly had "little firsthand information of the facts of the case" with testimony that was "primarily secondhand."
The presiding judge identified the "conceivable risks to victims' safety and privacy" as the compelling reason for preserving the documents under seal.
A parallel motion to unseal sealed witness accounts involving the legal case of his associate was also turned down, with the judicial officer noting that the federal petition incorrectly suggested the grand jury materials contained an "unexplored treasure trove of unrevealed details" about the proceedings.
The latest petition comes soon after the appointment of a new prosecutor to investigate the financier's connections with well-known politicians and a few months after the termination of one of the main lawyers working on the legal matters.
When asked about how the ongoing investigation might influence the release of related documents in federal custody, the chief law enforcement officer stated: "We cannot comment on that because it is now a active probe in the New York district."
